MESAFELİ SATIŞ SÖZLEŞMESİ

Madde 1 -  AMAÇ

Bu Mesafeli Satış Sözleşmesi, Alıcı tarafından Satıcı’nın internet sitesi üzerinden elektronik ortamda sipariş verilen ürünlere ilişkin tarafların hak ve yükümlülüklerini, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Satış Yönetmeliği kapsamında düzenler. Alıcı, sözleşme kurulmadan önce https://fleuofficial.com adresinde yer alan tüm ön bilgilendirmeleri incelediğini kabul eder.

Madde 3 - ÜRÜN BİLGİLERİ VE ÖDEME KOŞULLARI

3.1: Alıcı, ürünün temel nitelikleri, vergiler dahil toplam fiyatı, teslimat ve ödeme bilgileri hakkında önceden bilgilendirildiğini kabul eder.

3.2: Ürünün nitelikleri ve miktarı, internet sitesinde ve faturada yer aldığı şekildedir. Sipariş sonrası sipariş özeti ve sözleşme Alıcı’ya e-posta ile iletilir. 

3.3: Sistem kaynaklı fiyat hatalarında Alıcı bilgilendirilir; sipariş iptal edilir veya doğru fiyatla devam edilir.

3.4: Türkiye’de yerleşik Alıcılar Türk Lirası ile, yurt dışında yerleşik Alıcılar Euro veya USD ile ödeme yapar. VPN kullanılarak konum değiştirilmesi durumunda Satıcı siparişi iptal etme hakkına sahiptir.

3.5: Ödemeler tek çekim veya banka koşullarına göre taksitli olabilir; faiz ve masraflar bankaya aittir.

3.6: Teslimat için ürün bedelinin tamamen ödenmiş olması gerekir. Ödeme banka tarafından reddedilirse Satıcı ürünü teslim etmekle yükümlü değildir.

Madde 4 - TESLİMAT 

4.1: Teslimat süresi tahmini olarak bildirilebilir ancak hiçbir şekilde otuz günü aşmaz. Gecikme halinde Alıcı bilgilendirilir.

4.2: Teslimat, Alıcı’nın belirttiği adrese yapılır. Bu adreste bulunan herhangi bir kişiye teslimat geçerli sayılır. Teslimattan sonraki riskler Alıcı’ya aittir.

4.3: Alıcı ürünü teslim alırken kontrol etmeli ve ayıp tespit ederse derhal bildirmelidir.

Madde 5 - TARAFLARIN YÜKÜMLÜLÜKLERİ

5.1: Satıcı ürünü eksiksiz, hasarsız ve siparişe uygun şekilde teslim etmekle yükümlüdür.

5.2: Alıcı teslim sırasında ürünü kontrol etmeli; hasarlıysa teslim almamalı ve kargo görevlisine tutanak tutturmalıdır. Tutanak yoksa ürün sağlam kabul edilir.

5.3: Teslimatın imkânsız hale gelmesi halinde Satıcı üç gün içinde Alıcı’yı bilgilendirir ve ödemeleri on dört gün içinde iade eder. Stok yokluğu tek başına imkânsızlık sayılmaz.

Madde 6 - CAYMA HAKKI

6.1: Alıcı, on dört gün içinde hiçbir gerekçe göstermeden sözleşmeden cayabilir.

6.2: Cayma bildirimi sonrası ürün on gün içinde iade edilmelidir. Ürün kullanılmamış, giyilmemiş, yıkanmamış, zarar görmemiş, orijinal ambalajında, tüm aksesuarlarıyla, fatura ve iade formu ile birlikte ve sallantı etiket (hang tag) çıkarılmamış şekilde gönderilmelidir. 

6.3: Tüzel kişi faturalarında iade için ayrıca iade faturası düzenlenmelidir.

6.4: İade koşulları uygun ise bedel, iade onayından itibaren on dört gün içinde ödeme yapılan yönteme iade edilir. Koşulları sağlamayan ürün aynı adrese ücretsiz geri gönderilir.

Madde 7 - Cayma Hakkı Kullanılamayan Ürünler

Yılbaşı, Sevgililer Günü, Anneler Günü, Babalar Günü gibi özel günlere yönelik hazırlanmış ürünlerde cayma hakkı kullanılamaz.

Madde 8 - Uyuşmazlıkların Çözümü

Uyuşmazlıklar, 6502 sayılı Kanun’un 68. maddesindeki parasal sınırlar dâhilinde Alıcı’nın yerleşim yerindeki veya ürünün satın alındığı yerdeki Tüketici Hakem Heyetleri veya Tüketici Mahkemelerinde çözümlenir.

İADE POLİTİKASI

Alıcı, fleuofficial.com üzerinden satın aldığı ürünleri teslimden itibaren on dört gün içinde iade edebilir. Ürünlerin kullanılmamış, giyilmemiş, yıkanmamış, zarar görmemiş, orijinal ambalajında olması; fatura ve iade formu ile gönderilmesi ve sallantı etiketinin çıkarılmamış olması zorunludur.

Showroom’dan alınan ürünlerde iade kabul edilmez.

İade kargo ücreti, iade bedelinden düşülür.

Gönderim ücreti, vergi ve gümrük masrafları iade edilmez.

Tüzel kişi iadelerinde iade faturası zorunludur.

Ambalajı zarar görmüş, aksesuarı eksik veya kullanılmış ürünler kabul edilmez.

Özel gün ürünleri iade edilemez.

İadeniz onaylandığında e-posta ile bilgilendirilirsiniz. Bankaların işlem süreleri değişiklik gösterebilir.

KVKK AYDINLATMA METNİ

6698 sayılı Kişisel Verilerin Korunması Kanunu kapsamında Fleu tarafından kişisel verilerin işlenmesine ilişkin bilgilendirme metnidir. Kişisel veriler; ürün ve hizmet sunumu, müşteri kayıtlarının yönetimi, faturalandırma, kampanya bilgilendirmeleri, iletişim, müşteri ilişkileri, şikâyet süreçleri, pazarlama faaliyetleri, sistem güvenliği, finansal işlemler ve hukuki yükümlülükler amacıyla işlenebilir.

Kişisel veriler; iş ortakları, yetkili kurumlar, hizmet sağlayıcılar ve yasal olarak yetkilendirilmiş üçüncü kişilerle paylaşılabilir. Veriler, internet sitesi, sipariş işlemleri, e-posta, müşteri hizmetleri, sosyal medya ve elektronik ortamlar aracılığıyla toplanabilir. Veri sahipleri; bilgilendirme talebi, düzeltme, silme, itiraz ve tazminat haklarına sahiptir.

AÇIK RIZA METNİ

Aydınlatma metnini okuduğumu kabul eder, kişisel verilerimin ürün ve hizmetlerden faydalanmam, kampanyalar ve bilgilendirmeler için iletişim faaliyetleri kapsamında e-posta, telefon veya SMS yoluyla kullanılmasına açık rıza verdiğimi beyan ederim. Açık rızamı dilediğim zaman geri çekebilirim.

DISTANCE SELLING CONTRACT

Article 1 - PURPOSE

This Distance Selling Contract sets out the rights and obligations of the parties regarding products electronically ordered by the Buyer from the Seller’s website, in accordance with Consumer Protection Law No 6502 and the Distance Selling Regulations. The Buyer confirms having reviewed all mandatory information on https://fleuofficial.com before entering this Contract.

Article 2 - PARTIES

Article 3 - Product Information and Payment Terms 

3.1: The Buyer confirms having reviewed and understood the essential characteristics, total price including taxes, payment method and delivery terms, and acknowledges receiving all information required under the Distance Selling Regulations.

3.2: Product characteristics and quantities match the information displayed on the website and in the invoice. After the purchase, the order summary and a copy of this Contract are emailed to the Buyer. Any applicable delivery fees are also communicated.

3.3: If a pricing error occurs due to a system malfunction, the Buyer will be notified and may cancel the transaction or continue with the corrected price.

3.4: Prices and currencies vary depending on Buyer location. Buyers in Turkey pay in Turkish Lira; buyers outside Turkey pay in Euro or US Dollar. If the Buyer uses VPN technology to alter their location, the Seller may cancel the order. 

3.5: Payments may be made in single or multiple installments, subject to bank conditions; any interest or charges are determined by the relevant bank. 

3.6: Delivery requires full payment. For credit card payments, the Buyer must provide accurate card details. If payment fails or is cancelled by the bank, the Seller may terminate the Contract and is not obligated to deliver the product.

Article 4 - Delivery 

4.1: The Seller may provide an estimated delivery period; delivery will not exceed thirty days. In case of delay, the Buyer will be informed.

4.2: Delivery is made to the address provided by the Buyer. Delivery to any person at this address constitutes valid delivery. Any resulting risks or damages are the responsibility of the Buyer.

4.3: The Buyer must inspect the product immediately upon delivery and notify the Seller of any defects without delay.

Article 5 - Obligations of the Parties

5.1: The Seller must deliver the product in accordance with the order, complete, undamaged and with all required documents.

5.2: The Buyer must inspect the product at delivery; if damaged, delivery must be refused and a courier report requested. If no report is issued, the product is considered delivered in good condition.

5.3: If delivery becomes impossible, the Seller must notify the Buyer within three days and refund all payments, including delivery costs, within fourteen days. Lack of stock alone does not constitute impossibility.

Article 6 - Right of Withdrawal

6.1: The Buyer may withdraw from the Contract within fourteen days without providing any reason, by notifying the Seller via email.

6.2: The Buyer must return the product within ten days of submitting the withdrawal notice. Returned products must be unused, unworn, unwashed, undamaged, in original packaging, include all accessories, include the invoice and return form, and must have the original hang tag attached; products with removed hang tags cannot be accepted.

6.3: Corporate customers must include a return invoice; returns cannot be processed without this document. 

6.4: Refunds are issued to the original payment method within fourteen days of approval. If the return does not meet the required conditions, the product will be sent back to the Buyer at no cost.

Article 7 - Products Excluded From Withdrawal 

Products specially prepared for Christmas, Valentine’s Day, Mother’s Day or Father’s Day cannot be returned.

Article 8 - Dispute Resolution 

Disputes arising from this Contract shall be resolved by Consumer Arbitration Committees or Consumer Courts within the monetary limits set forth in Law No 6502, based on the Buyer’s place of residence or the place where the product was purchased.

RETURN POLICY

You may return any product purchased from fleuofficial.com within fourteen days without providing any reason. Returned products must be unused, unworn, unwashed, undamaged, in original packaging, include the invoice and return form, and must have the original hang tag attached. Products with removed hang tags cannot be accepted.

Products purchased from Fleu showrooms cannot be refunded.

Return shipping costs are deducted from the refund.

Original shipping fees, duties and taxes are non-refundable. 

Corporate customers must include a return invoice.

Products with damaged packaging, missing accessories or signs of use will not be accepted. Special-day products (Christmas, Valentine’s Day, Mother's Day, Father's Day) are not returnable.

Once your return is processed, you will be notified by email. Refund timing may vary by bank.

PERSONAL DATA DISCLOSURE STATEMENT

Prepared under the Law on the Protection of Personal Data No 6698 to inform customers regarding the processing of personal data by Fleu. Personal data may be processed for: providing products and services, customer management, invoicing, campaigns, communication, customer service, complaint handling, marketing operations, platform security, financial processes and legal compliance. Personal data may be transferred to business partners, service providers, legally authorized institutions and other third parties. Personal data may be collected verbally, in writing or electronically via website interactions, orders, emails, social media or customer service. Data subjects may request information, correction, deletion, objection or compensation, in accordance with Articles 11 and related provisions of the Law.

EXPLICIT CONSENT FORM

I acknowledge that I have read the Personal Data Disclosure Statement and I grant explicit consent for my personal data to be processed for receiving products and services, offers, campaigns and communication via email, SMS or telephone. I understand that I may withdraw my consent at any time.
